1. Website Presentation
Le present site internet (ci-apres « le Site ») est la propriete de Sophie Fernet, artiste peintre (ci-apres « l'Artiste »). Le Site a pour objet la presentation des oeuvres originales de l'Artiste.
2. Intellectual Property
All content displayed on the Site, including but not limited to photographs, artwork reproductions, texts, graphic elements, logos, and layout, is protected by copyright under Norwegian copyright law (Lov om opphavsrett til andsverk mv., andsvekloven) and applicable international conventions, including the Berne Convention for the Protection of Literary and Artistic Works.
The Artist holds all economic and moral rights (ideelle rettigheter) over the works presented on the Site. These moral rights are inalienable and perpetual under Norwegian law.
3. Interdiction de reproduction et d'utilisation
Any reproduction, representation, modification, publication, or adaptation, in whole or in part, of the works and content of the Site, by any means and on any medium, is strictly prohibited without the Artist's prior written consent.
This prohibition includes in particular:
- copying, screenshotting, downloading, or saving artwork images;
- reproduction on any physical or digital medium;
- distribution, sharing, or making available on the internet, social networks, or any other media;
- use for commercial, advertising, or promotional purposes;
- use for training, developing, or feeding artificial intelligence systems, machine learning, or generative models;
- any modification, cropping, transformation, or creation of derivative works;
- use for editorial purposes without prior written authorization.
4. Site Browsing
Browsing the Site is authorized strictly for personal and private use. It grants no ownership or usage rights over the works displayed. Any use beyond private browsing requires the Artist's written authorization.
5. Technical Protection Measures
The Site implements technical measures to protect works against unauthorized copying. Any attempt to bypass these measures constitutes an offense under Norwegian law and applicable international legislation.
6. Demande d'autorisation
Any request for authorization to use the works must be sent in writing to the Artist via the Site contact form. If granted, authorization is limited to the specifically defined use and may not be transferred to a third party.
7. Personal Data Collection
The Site may collect personal data via the contact form (name, email address). This data is used only to respond to received messages and is neither kept beyond what is necessary nor transmitted to third parties. In accordance with the General Data Protection Regulation (GDPR) and Norwegian personal data law (Personopplysningsloven), you have the right to access, rectify, and delete your data.
8. Cookies et analyse d'audience
Le Site utilise Matomo, un outil d'analyse d'audience respectueux de la vie privee, configure pour respecter le signal « Do Not Track » de votre navigateur. Les donnees collectees sont anonymisees et hebergees sur nos propres serveurs.
9. Liability
The Artist strives to provide accurate information on the Site, but cannot guarantee completeness or accuracy of content. The Artist reserves the right to modify Site content at any time without notice.
10. Applicable Law and Competent Jurisdiction
These general terms of use are governed by Norwegian law. In the event of a dispute, Norwegian courts shall have exclusive jurisdiction.
Any violation of these terms, and in particular any infringement of the Artist's copyright, may result in civil and criminal proceedings under Norwegian copyright law (andsvekloven), which provides sanctions including damages and possible imprisonment.
